Terms of Use

These terms govern your use of nomead.app, book.nomead.app and the Nomead apps (the "Service"), run by Nomead ("Nomead", "we", "us"). By creating an account, booking a pass or otherwise using the Service you agree to them, to our Privacy Policy and to our Cancellation and Refund Policy. If you do not agree, please do not use the Service.

1. Who can use Nomead

You must be 18 or older and able to enter a binding contract under Indian law. Gym owners listing a venue confirm they are authorised to do so for the business. Keep your sign-in details to yourself and tell us at once if you think someone else has used your account. You are responsible for activity under it.

2. What Nomead does

Nomead lets you discover gyms, yoga studios, pools and similar venues ("Gyms") and buy passes ("Passes") that give you entry for the number of days you buy. Gyms are independent businesses. They set their own prices, facilities, hours and house rules. We take bookings and payments on the Gym's behalf, and the Pass is a contract between you and the Gym for the use of its facilities.

We try to keep listings accurate, but we do not inspect Gyms or guarantee their facilities, equipment, trainers or safety.

3. Booking and using a Pass

• A booking is confirmed only after payment succeeds and your Pass appears in the app.
• Show the Pass QR code at the desk. A Pass is personal to you (plus any guests included in the booking) and cannot be resold or transferred.
• A Pass is valid only for the dates and visits shown. Unused days do not roll over unless the Gym agrees.
• Follow the Gym's rules, staff instructions and any identification or waiver the Gym requires. A Gym may refuse entry for unsafe behaviour or breach of its rules, and in that case no refund is due unless the law says otherwise.

4. Prices, fees and payment

Prices are in Indian rupees and shown before you pay. The total at checkout includes the Pass price and any service fee, plus taxes where they apply. Payments are processed by Razorpay by card, UPI and other methods it offers. You can also pay with Nomead credits you have bought.

Credits can be spent on Passes. They are personal to your account, have no cash value, and cannot be transferred. Bonus credits are a promotion and may be changed or withdrawn for future top-ups.

Beta and test mode. While the Service is marked "Test", payments may run in test mode, where no real money moves and a Pass is not a real booking. Checkout tells you when this is so.

5. Cancellations and refunds

You can cancel for free up to 24 hours before your Pass starts. The full rules are in our Cancellation and Refund Policy, which is part of these terms.

6. Gym owners

If you list a Gym you agree to: give accurate details and photos you have the right to use; honour every Pass sold; keep prices and hours up to date; scan members in fairly; and keep your own licences, insurance, tax registrations and facility safety in order. Payouts are made through Razorpay to your linked account, minus any commission we agree with you. You are the seller of the Pass and responsible for your own taxes. We may remove a listing that is inaccurate, unsafe or in breach of these terms.

7. Reviews and content

You keep ownership of reviews and photos you post, and give us a non-exclusive, free licence to display them on the Service. Do not post anything unlawful, false or abusive, or anything you do not have the right to share. We may remove content that breaks these terms.

8. Acceptable use

You agree not to: use the Service for anything unlawful; resell or share Passes; create fake bookings or reviews; interfere with or probe the Service's security; scrape it or use bots; reverse-engineer it; or use it to build a competing service. Nomead, its logo and the Service's content belong to us or our licensors, and you get only a limited, personal, revocable licence to use the Service.

9. Health and safety

Exercise carries risk. You are responsible for deciding whether you are fit to train and for following the Gym's safety rules. Check with a doctor if you are unsure. To the extent the law allows, Nomead is not responsible for injury, loss or damage that happens at a Gym; that is a matter between you and the Gym. Nothing here limits liability that cannot be limited by law.

10. Disclaimers and liability

The Service is provided "as is" and "as available". We do not promise it will always be uninterrupted or error-free. To the fullest extent the law allows, Nomead is not liable for indirect or consequential loss, and our total liability to you for any claim is limited to the greater of ₹1,000 and the amount you paid us in the six months before the claim arose.

11. Ending your account

You can stop using the Service and delete your account at any time. We may suspend or end your access if you breach these terms or misuse the Service. Paid Passes you are entitled to will be honoured or refunded under the refund policy.

12. Changes

We may update these terms. If a change matters, we will tell you in the app or by email before it applies. Using the Service afterwards means you accept the new terms.

13. Governing law and disputes

These terms are governed by the laws of India. Please write to hello@nomead.app first so we can try to settle a problem informally. If we cannot, the courts at Kochi, Kerala have exclusive jurisdiction, without taking away any right you have as a consumer to approach a Consumer Commission or other forum that applies to you.
